TRADEMARK GUIDELINES “The Goodeys®”
As of January 2023
These trademark guidelines explain the legal use of the “The Goodeys” word mark, the “The Goodeys” app icon, the “The Goodeys” logo, the “The Goodeys” emojis, all “The Goodeys” artworks and all others features and product names related to “The Goodeys” such as “Baby Goodeys”, “The Goodeys Racing Team” etc.
1. The Goodeys brand name
The “The Goodeys” brand name is protected by patent and may not be used without permission from Up!Graphix. Please send your request to: licensing@upgraphix.com
Furthermore, it is not permitted to change the word mark "The Goodeys" by changing the capitalization or to remove or add letters. In particular, it is not permitted to use the “The Goodeys” word mark for any commercial, non-commercial, public or private purpose (e.g. merchandising), or to support or enable anyone else to do so, unless the usage rights have been lawfully acquired by Up!Graphix .
2. The "The Goodeys" logo
The “The Goodeys” logo is protected by patent and may not be used without permission from Up!Graphix.
It is not allowed to
1. to display distorted, to rotate, to invert the logo or similar
2. change the colors or modify the transparency of the logo
3. draw a border around the logo
4. to put a shadow behind the logo
5. Remove the ® sign
6. add or remove something to or from the logo
7. or alienate or change the logo in any way.
In particular, it is not permitted to use the "The Goodeys" logo for any commercial, non-commercial, public or private purposes (such as merchandising), or to support or enable anyone else to do so, unless the usage rights have been lawfully granted by Up! Graphix acquired.
3. The Goodeys figurative mark
The unique shape of the non-circular circle of The Goodeys is protected several times by patents and may not be copied or used to design your own emojis.
a. The color variations of The Goodeys (yellow, red, blue, green, purple, black, orange etc.) are protected by patent.
b. The eyes, mouths and especially all hands of The Goodeys are based on the artwork of Up!Graphix and are protected by patents; they may not be copied or used to design your own emojis.
c. It is not allowed to use The Goodeys and / or parts of The Goodeys without permission or the required licenses. The respective rights are granted through licensing by Up!Graphix. Please send your request to licensing@upgraphix.com.
In particular, it is not permitted to use the "The Goodeys" emojis for any kind of commercial, non-commercial, public or private purposes (e.g. merchandising), or to support or enable anyone else to do so, unless the usage rights have been lawfully granted by Up!Graphix acquired.
The content of The Goodeys may not be changed. No parts of the emojis may be used or separated.
4. The design of The Goodeys
All items and accessories (e.g. hats, hair, glasses, caps, balloons, etc.), as well as guitars and bass guitars, crazy cars and other designs are based on the artwork of Up!Graphix.
It is not allowed to use The Goodeys and / or parts of The Goodeys without permission or the required licenses. The respective rights are granted by Up!Graphix.
In addition, it is not permitted to copy the "look and feel" of The Goodeys.
5. The usage of "The Goodeys" word and figurative marks and artwork
It is not permitted to
a. use "The Goodeys" word and figurative marks and artwork in a way that implies partnership, sponsorship and / or endorsement by "The Goodeys" or Up!Graphix,
b. integrate “The Goodeys" word and figurative marks and artwork or confusingly similar into other brands, names, domain names, user names or logos,
c. use ”The Goodeys” word and figurative marks, which are put into circulation by third parties without permission,
d. use trademarks, names, domain names, usernames, logos or other content that imitate "The Goodeys" word and figurative marks and or can lead to irritation,
e. use "The Goodeys" word and figurative marks in connection with pornographic, commercially erotic or extremist content,
f. use "The Goodeys" word and figurative marks in such a way that their provision, public access or use violate the rights of third parties or applicable law,
g. take actions with the "The Goodeys" word and figurative marks that violate legal provisions or violate the rights of others or misuse the emoticons in any other way.
Furthermore, The Goodeys may not be used in this way or put someone else in a position to use them in such a way that they violate public rights, data protection rights, copyright rights, trademark rights or other intellectual property rights of others.
It is not permitted to copy, archive, download, upload, distribute, syndicate, broadcast, perform, display, make available or otherwise use The Goodeys or parts thereof without permission, unless this is permitted by the Up!Graphix Terms of Service is allowed.
6. Copyright notices
The user undertakes to provide the following copyright information in each of his media using the Up!Graphix emojis:

7. Protection of copyrights
In the event of a violation of the copyrights named in these trademark guidelines, the rights owner “Up!Graphix” will take appropriate legal action against the person who caused the violation.
8. Update
